Dallas, Texas – Beginning September 1st, Texas asbestos cancer victims now have new legal hurdles to overcome if they want their day in court. Texas HB1492 was enacted by Texas Governor, Greg Abbott, over the summer and became effective on Tuesday.
The new law requires asbestos claimants to make claims against all bankrupt asbestos companies that they may qualify for recovery from before the asbestos victim can obtain a trial date.
In addition to requiring the plaintiff to file bankruptcy claims, HB 1492 also allows a defendant to identify additional bankruptcy claims the defendant feels the claimant can make. In the process, the trial date can be delayed. For Texans with life-threatening illnesses, justice delayed may indeed be justice denied.
